1. この利用規約（以下「本規約」といいます。）は、ハイアット リージェンシー 東京（以下「当ホテル」といいます。）が提供するFree Wi-Fiサービス（以下「本サービス」といいます。）を、本規約第3条に定める利用者（以下「利用者」という。）が利用する場合に適用します。
2. 利用者は、本サービスの利用にあたり、本規約のほか、利用条件およびその他の告知（以下併せて「本規約等」といいます。）を遵守する義務を負うものとします。
3. 当ホテルは、利用者の了承および事前の予告を経ることなく、本サービスおよび本規約等の内容を改訂・追加・変更または廃止することができるものとします。また、利用者は、本サービスおよび本規約等の変更に対し、異議の申し立て、権利の主張、その他一切の請求をすることができないものとします。
当ホテルが利用者に対して提供する本サービスの内容は、以下に定めるとおりとします。ただし、利用者は、その利用する情報端末機器の性能等によって、本サービスの一部または全部を利用できない場合があることを異議なく了承するものとします。
1. 当ホテルは、次項に定める利用者登録手続きを経たうえで、当ホテルによる利用者登録の承認を受けたお客様に対し、本サービスの利用者としての地位を付与します。
2. 本サービスの利用を希望するお客様は、本規約等に同意の上、以下のいずれかの方法による利用者登録手続きを行うものとします。当該利用者登録手続きの後、当ホテルがお客様の利用者登録を承認した時点で、当ホテルとお客様との間における本サービスの利用に関する契約（以下「利用契約」といいます。）が成立するものとします。
3. 利用者は、利用者登録手続きに関わる情報について真実、正確かつ最新の情報を提供しなければならないものとし、虚偽の記載をした場合には、当ホテルは利用契約を何らの催告なく解除できるものとします。
利用者は、本サービスの利用者として有する地位、権利および義務の一切を、当ホテルの事前の承諾なく第三者に譲渡し、または担保に供してはならないものとします。
1. 本サービスの利用料は無料とします。ただし、本サービスを利用するために必要な通信機器等の設備、インターネット接続に関わる通信費用、接続費用等の費用は利用者が負担するものとします。
2. 前項の定めにかかわらず、本規約第1条3項の定めにより、本サービスの全部または一部について事後的に利用料等が定められた場合は、当該サービスを利用する利用者は、当該サービスの利用により、利用料等の変更に異議なく承諾したものとし、定められた利用料等を支払うものとします。
1. 当ホテルは、利用者が本サービスを利用する際に、以下の情報（以下「履歴情報および特性情報」といいます。）を取得し、管理し、利用するものとし、利用者はこれに同意します。
2. 当ホテルは、履歴情報および特性情報を以下の目的にのみ利用します。
3. 当ホテルは、利用者の履歴情報および特性情報について、本規約に定める場合を除き、利用者の同意なく第三者に提供または開示しないものとします。ただし、法令により開示を求められた場合は、この限りではありません。
利用者は、利用登録時に入力した当該SNSサービスのログイン情報（アカウントおよびパスワード）のほか、メールアドレスを、利用者本人の責任にて管理するものとします。それらの情報が漏えいし、第三者に使用等されたことによる利用者の不利益および損害について、当ホテルは一切の責任を負いません。
利用者は、本サービスを利用するに際して、以下に掲げる禁止事項を行わないものとします。当ホテルは、利用者が当該禁止事項を行ったことを発見した場合、なんらの通告なく当該利用者による本サービスの利用を停止することができるものとします。
1. 当ホテルは、本サービスに不具合、障害等の瑕疵がないこと、および本サービスが中断なく稼動することをなんら保証しません。また、特定の目的に対する適応性、知的財産権その他の権利の侵害等に対してもなんら保証しません。当ホテルは、本サービスにいかなる不備があってもそれを回復、訂正等する義務を負いません。
2. 当ホテルは、利用者が本サービスを使用すること、または、使用できなかったことによって損害、トラブル等が生じた場合であっても、いかなる責任も負いません。
3. 当ホテルは、以下に掲げる場合（利用者の情報の消失、毀損を含みますがこれらに限定されません）等において、利用者に生じる損害、トラブル等に関して、その原因如何を問わず、いかなる責任も負いません。
4. 本サービスにおいて利用者が書き込んだツイート等の各種情報等が本規約に定める事項の一つにでも違反した場合、第9条の定めにしたがって本サービスの使用を停止する場合がありますが、それによって生じた一切の損害に関していかなる責任も負いません。また、当ホテルは、利用者が書き込んだツイート等の各種情報等に本規約の違反があってもそれを削除等する義務を負いません。
5. 当ホテルは、本サービスの仕様に関するご質問には一切お答えできません。
1. 利用者は、本規約等に違反した結果として、当ホテルまたは第三者に損害が生じた場合、当ホテルおよび損害を被った者に対し、その損害を負担するものとします。
2. 利用者は、本サービスの利用に関し、第三者との間で紛争等が発生した場合、自己の費用と責任においてその一切を解決し、当ホテルになんらの損害等を被らせないものとします。
当ホテルが必要と認める場合、当ホテルはなんらの通知を行うことなく、本サービスの機能の一部または全部を中止または終了することがあります。なお、当該中止または終了により利用者に損害が生じた場合であっても、当ホテルはいかなる責任も負いません。
当ホテルは利用終了までに取得した利用者に関する一切の情報を、本規約第6条に定める利用目的の範囲内で引き続き利用することができるものとし、利用者はこれに同意するものとします。ただし、当ホテルは、利用終了した利用者に関する履歴情報および特性情報を、引き続き保持する義務を負うものではなく、当ホテルが適切と判断する方法によって破棄することができるものとし、利用者はこれに同意するものとします。
本規約に関する準拠法は日本法とし、日本国の法律にしたがって解釈・適用されるものとします。また、本規約は、日本語文に準拠するものとし、外国語による訳文との内容に不一致があった場合には、日本語文のみにしたがって解釈・適用されるものとします。
また、本規約また本サービスに関連して当ホテルと利用者との間で紛争が生じた場合、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所とします。
1. These terms of use (“TOU”) shall apply to the users defined in Article 3 hereof (“Users”) when the Users use Free Wi-Fi and other services (“Services”) provided by Hyatt Regency Tokyo. (“Hotel”).
2. In order to use the Services, Users shall assume the obligation to comply with this TOU and other notices, provided by the Hotel (collectively, “TOU and Others”).
3. The Hotel shall be entitled to revise, make additions to, change or eliminate, the contents of the Services and TOU and Others without the consent of, or prior notice to, Users. Users shall not be entitled to make an objection, assert its right, or otherwise claim against any change to the Services and TOU and Others.
The content of the Services provided by the Hotel to Users shall be as set forth below, provided, however, that Users shall, without objection, accept the possibility that the Services in whole or in part may not be available to Users due to the performance or the like of their information terminal equipment.
1. The Hotel will grant the status as a User of the Services to a customer who is approved by the Hotel through User registration after the User registration procedure is followed as set forth in the following paragraph.
2. Any customer who wishes to use the Services shall agree to the TOU and Others, and follow the User registration procedure in either of the manners described below. The agreement regarding the use of the Services between the Hotel and a User (“Use Agreement”) shall be deemed to be concluded when the Hotel approves the User registration of the User after the relevant User registration procedure is followed.
3. Users shall provide true, accurate and updated information in relation to the User registration procedure and the Hotel shall be entitled to terminate the Use Agreement without any notice if the User makes a false statement.
No User shall, without the prior consent of the Hotel, assign to a third party, or pledge, his/her status or any of his/her rights and obligations as a User of the Services.
1. No service fees shall be charged for the Services, provided, however, that the costs for any necessary communication equipment to use the Service, communications over the Internet, communications and connections, etc. shall be borne by the User.
2. Notwithstanding the provisions of the preceding paragraph, if a service fee or the like is subsequently set for the Services in whole or in part pursuant to the provisions of Paragraph 3 of Article 1 hereof, the Users of such Services shall, by using such Services, be deemed to accept the change to the service fee or the like without objection and shall pay the set service fee or the like.
1. The Hotel shall acquire, manage and use the following information (“History and Property Information”) when Users use the Services, and Users agree to such acquisition, management and use.

3. Unless otherwise provided for in this TOU, the Hotel shall not, without the consent of Users, provide or disclose their History and Property Information to third parties, except as disclosure is required by law.
Users shall, under their own responsibility, manage the login information for the corresponding SNS service (accounts and passwords) and e-mail address entered at the time of registration as a User. The Hotel will not be responsible or liable for any detriment or damage incurred by Users due to the like or use by third parties of said information.
While using the Services, Users shall refrain from conducting the acts listed below. If the Hotel finds that a User has conducted any of the prohibited acts, the Hotel shall be entitled to suspend the use of the Services by the User without any notice.
1. The Hotel makes no warranty that the Services are free from problems, failures or other defects, or that the Services will operate without disruption. The Hotel also makes no warranty of the fitness of the Services for a particular purpose or against infringement of intellectual property rights or the like. The Hotel has no obligation to recover, correct or otherwise deal with, any defect in the Services.
2. The Hotel will not be responsible or liable for any damage, trouble or the like caused by the use or unavailability of the Services by or to Users.
3. In the event of any of the following (including, but not limited to, loss of or damage to User information), the Hotel will not be responsible or liable for any damage, trouble or the like incurred by Users, whatever the cause.
4. If a tweet or information written by a User breaches any of the terms set forth herein, the Hotel suspend the use of the Services pursuant to the provisions of Article 9, provided, however, that the Hotel will not be responsible or liable for any damage caused by the said action. If any tweet or information written by a User breaches this TOU, the Hotel has no obligation to remove or otherwise deal with such information.
5. The Hotel will not be able to answer any questions about the specifications of the Services.
1. If a User breaches the TOU and Others and causes damage to the Hotel or a third party, the User shall be liable to the Hotel or the damaged party for such damage.
2. In the event of any dispute or the like between a User and a third party in connection with the use of the Services, the User shall settle such dispute at his/her own expense and under his/her own responsibility and shall hold the Hotel harmless from any damage or the like.
If deemed necessary by the Hotel, the Hotel may, without any notice, discontinue or terminate the functions of the Services in whole or in part, provided, however, that the Hotel will not be responsible or liable for any damage incurred by Users due to such discontinuation or termination.
Users agree that the Hotel shall be entitled to continue using, to the extent of the purposes set forth in Article 6 hereof, any information on Users acquired before end of use. Users further agree that the Hotel has no obligation to keep the History and Property Information on the Users, who have end the use, and shall be entitled to discard such information in a manner deemed appropriate by the Hotel.
This TOU shall be governed by, interpreted and applied in accordance with, the laws of Japan. This TOU shall be governed by the text of the Japanese language version, and in the event of any discrepancy between the text of the Japanese language version and a translated version in another language, this TOU shall only be interpreted and applied in accordance with the Japanese text.
The Tokyo District Court or the Tokyo Summary Court shall have exclusive jurisdiction by agreement for the first instance over any dispute between the Hotel and a User in connection with this TOU or the Services.
